General Terms and Conditions for Workshops of DICTUM GmbH
§ 1 Scope of application
These General Terms and Conditions (hereinafter "GTC") apply to all registrations made and contracts concluded with DICTUM GmbH (hereinafter "Dictum") in writing, by telephone, in person, by email or via the dictum.com website.
§ 2 Conclusion of contract
Registration for a DICTUM workshop can be made in writing, by telephone, in person, by email or via our website dictum.com. The contract is concluded upon receipt of the registration confirmation. The scope of services is set out in the offer, the contract or the order confirmation signed by both parties. Content and/or organisational changes are permitted, provided they do not significantly change the core of the agreed performance. When registering third parties, their full contact details must be provided.
§ 3 Course fees and Material costs
All prices include the statutory value added tax. Material costs are shown separately and - unless otherwise stated - are to be paid on site.
§ 4 Terms of payment
The course fee will be invoiced no later than four weeks before the start of the course. Payment is due within 15 days of invoicing. If direct debit authorisation has been granted (SEPA direct debit or credit card), payment will be debited automatically. In the event of late payment, we reserve the right to allocate the course place to another participant.
§ 5 Cancellation by the participant
Cancellation is possible in text form. The following cancellation fees apply:
- Up to 31 days before the start of the course: 5 % of the course fee
- 30 to 1 day before the start of the course: 100 % of the course fee
- Garde: 100 % of the course fee.
§ 6 Right of cancellation
In accordance with § 312g Para. 2 Garde. 9 BGB, there is no right of cancellation, as these are services in connection with leisure events that take place on a specific date.
§ 7 Course implementation and cancellation
In order to be able to organise the workshops under optimal conditions, DICTUM sets a minimum and maximum number of participants for each course. These can be adjusted if necessary. Course places are allocated in the order in which registrations are received, subject to timely payment. DICTUM reserves the right to postpone or combine courses for organisational reasons, to change the venue or to reduce the course fee with a pro rata refund. If a course leader is unavailable, a change of course leader or a replacement can be made. If it is not possible to hold the course in a face-to-face format (e.g. due to force majeure), the course can be converted to a distance learning format under the same conditions. If the number of participants is insufficient, the course will generally not be held; course fees already paid will be refunded in full. In individual cases, DICTUM may nevertheless hold the course if all participants agree - either with an increased course fee or with a reduced course duration at the same price. DICTUM also reserves the right to cancel announced courses for other reasons for which DICTUM is not responsible. In this case, any course fees already paid will also be refunded in full. Any further claims by participants, in particular for damages, are expressly excluded, provided there are no mandatory statutory provisions to the contrary.
§ 8 Liability
Participation in our workshops is at the participant's own risk. During the course, participants are covered by accident insurance through our public liability insurance. The instructions of the course management and staff must be followed. Work on machines is only permitted after prior instruction and with the express consent of the course management. In the event of gross negligence, disregard of safety instructions or consumption of Alcohol content or drugs, we reserve the right to exclude the participant from the course. DICTUM is liable without limitation for damages resulting from injury to life, body or health caused by a negligent or intentional breach of duty by DICTUM, its legal representatives or vicarious agents. Otherwise, liability is limited to intent and gross negligence. Any further liability - in particular for indirect damage or loss of profit - is excluded, insofar as this does not conflict with any mandatory statutory provisions.
§ 9 Copyright and right of use
The rights to Content, concepts and Material remain with DICTUM GmbH. Utilisation is only permitted within the agreed framework. Reproduction, forwarding or publication require written authorisation.

§ 11 Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Supplementary validity of the general terms and conditions
Insofar as these Workshop T&Cs do not contain any deviating provisions, the General T&Cs of DICTUM GmbH shall apply in addition: www.dictum.com/agb
In the event of contradictions, the Workshop T&Cs shall take precedence.
§ 13 Final provisions
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions of the General Terms and Conditions. In such a case, the invalid provision shall be replaced by a valid provision which achieves the intended purpose of the contract in a legally permissible manner and which comes closest to the original intention in terms of its content. The same applies in the event of a loophole.
